Welcome to GoPassy. By downloading, installing, or using the GoPassy mobile application (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using GoPassy, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms and our Privacy Policy.

2. Description of Service

GoPassy is a mobile application that allows users to create QR code passes containing personal or professional information (such as name, headline, and URL) and add them to Apple Wallet. The App offers a free tier with limited features and a paid subscription tier (GoPassy Pro) with additional features.

3. User Accounts

• You must provide a valid email address and create a password to register.
• You must verify your email address before accessing the App.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You may not create accounts for the purpose of violating these Terms or for fraudulent activity.

4. Free and Pro Tiers

Free Tier: Allows you to create and save up to 3 passes at no cost.

Pro Tier ($3.99/month): Provides unlimited pass creation and priority support. The subscription is billed monthly through Apple's App Store and automatically renews unless cancelled at least 24 hours before the end of the current billing period.

5. Subscriptions and Billing

• All payments are processed by Apple through the App Store. GoPassy does not directly collect or store your payment information.
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your device's Settings > Apple ID > Subscriptions.
• No refunds will be provided for the current subscription period after cancellation. Refund requests must be directed to Apple.
• Deleting your GoPassy account does not automatically cancel your Apple subscription. You must cancel it separately.

6. User Content

You retain ownership of all content you create within GoPassy (names, headlines, URLs). By using the App, you grant us a limited license to store and process this content solely for the purpose of providing the service.

You agree not to use GoPassy to:

• Create passes containing illegal, harmful, or offensive content
• Impersonate another person or entity
• Distribute malware or malicious links through QR codes
• Violate any applicable laws or regulations

7. Intellectual Property

The GoPassy app, including its design, code, brand name, logo, and visual identity, is the property of GoPassy and is protected by copyright and intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Apple Wallet Integration

GoPassy generates .pkpass files for use with Apple Wallet. This feature depends on Apple's PassKit framework and our backend server. We do not guarantee uninterrupted availability of the Apple Wallet integration, as it may be affected by Apple's platform changes or our server maintenance.

9. Account Deletion

You may delete your account at any time through the Profile section of the App. Account deletion will permanently remove:

• Your profile data
• All saved passes
• Your authentication credentials

This action is irreversible. Passes already added to Apple Wallet will remain on your device but will no longer sync with GoPassy.

10. Disclaimer of Warranties

GoPassy is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy of QR codes generated by the App — it is your responsibility to verify your pass information is correct.

11. Limitation of Liability

To the maximum extent permitted by law, GoPassy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, including but not limited to loss of data, loss of business opportunities, or damages resulting from errors in generated QR codes or passes.

12. Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms. Upon termination, your right to use the App will immediately cease.

13. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
